1. Agreement to these Terms
These Terms of Use (“Terms”) are a legally binding agreement between you and The Trustee for the 4 Good Unit Trust (ABN 85 145 868 031) trading as The Thompson Method (“we”, “us”, “our”), based in Queensland, Australia.
By creating an account or using the Dr Robyn AI Support Chat (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. Who can use the Dr Robyn AI Support Chat
You must be at least 18 years old and capable of entering a binding contract. By using the Service you confirm that you meet these requirements and that the information you provide to us is accurate.
3. What the Dr Robyn AI Support Chat is and what it is not
The Dr Robyn AI Support Chat provides breastfeeding and infant feeding education and general support, drawing on the principles of The Thompson Method and referring to videos from the Thompson Method Breastfeeding Program.
Please read this section carefully before using the Service.
- The Service provides general educational information only. It does not replace medical, midwifery, lactation, nursing or other professional health advice, and it is not a diagnostic tool.
- Nothing in the Service creates a healthcare practitioner–patient relationship between you (or your baby) and us, our team, or anyone whose content appears in the Service.
- The Service is not a substitute for the individual advice of your doctor, midwife, child health nurse, lactation consultant or other qualified health professional, who knows your and your baby’s specific circumstances.
- Always seek the advice of a qualified health professional for any questions about your or your baby’s health, feeding, weight gain or wellbeing. Never disregard professional advice or delay seeking it because of something you have read or received in the Service.
- In an emergency, or if you are concerned your baby is unwell, contact your local emergency services (000 in Australia, 911 in the USA) or your health provider immediately. Do not rely on the Service in urgent situations.
The Dr Robyn AI Support Chat is powered by artificial intelligence and generates responses automatically. Responses may be incomplete or inaccurate and carry the same limitations as all other content in the Service: they are educational only and are not medical advice.
You are responsible for decisions you make about your own and your baby’s wellbeing.
4. How the Dr Robyn AI Support Chat works
The Dr Robyn AI Support Chat uses a large language model (“LLM”) operated by Anthropic, PBC (“Anthropic”), accessed through Amazon Web Services (AWS). Key features of how it operates:
- The chat is stateless between sessions. It does not retain memory of previous conversations and cannot access your feeding data, profile or account history from session to session.
- Each new conversation starts fresh. If you want the assistant to take prior context into account, you must provide it yourself within that session.
- Personal health information you share in a chat session is processed to generate a response. Before being sent to the AI model, your information passes through a de-identification process on our infrastructure that strips Protected Health Information (PHI) — it is not sent to Anthropic in identifiable form.
- We do not permit your personal information to be used to train third-party AI models, including Anthropic’s models. Our agreement with Anthropic includes a Business Associate Agreement (BAA) that governs the handling of health information.
- Transcripts of your chat sessions are retained while your account is active (see Section 8 of our Privacy Policy). Our team reviews chats — including to confirm the AI provided accurate information — and may access your transcript and email you at the address you signed in with to correct information, follow up, or share additional resources.
5. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Your account is personal to you and may not be shared. Please notify us at care@thethompsonmethod.com if you suspect unauthorised access.
6. Subscriptions, billing and cancellation
6.1 Plans and pricing
The Dr Robyn AI Support Chat is included in a paid subscription to The Thompson Method or My Milk Map. Current plans and prices are displayed at checkout. Plans may include monthly and annual options, as well as limited-time promotional offers. Prices are shown in the currency stated at checkout and include GST where applicable.
6.2 Billing and renewal
- Payments are processed securely by Stripe or Kajabi Payments.
- Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
- We will give you advance notice of any price increase affecting your plan; the new price applies from your next renewal after the notice period.
6.3 Cancellation
You can cancel at any time through your account settings or by contacting care@thethompsonmethod.com. Cancellation takes effect at the end of your current billing period; you retain access until then.
Removing or uninstalling the app from your device does not cancel your subscription. You must cancel through your account settings or by contacting us, or billing will continue.
Unless a refund is required by law (see 6.4) or stated in a specific offer, fees already paid are not refunded for the unused portion of a billing period.
6.4 Refunds and your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL or other applicable law. If the Service has a major failure, you are entitled to the remedies the ACL provides, which may include a refund.
6.5 Free trials and promotional offers
Where a free trial or promotional price is offered, the specific terms presented at sign-up apply. Unless stated otherwise, a trial converts to a paid subscription at the end of the trial period unless you cancel first.
7. Acceptable use
You agree not to:
- use the Service unlawfully or to harm others;
- upload or share content that is unlawful, abusive, defamatory or infringes anyone’s rights;
- attempt to access other users’ data or any non-public part of our systems;
- attempt to manipulate, jailbreak or circumvent the AI model’s safety guidelines or intended educational scope;
- reverse engineer, scrape, data-mine or copy the Service or its content, including using automated tools or AI systems to extract content or data;
- resell, sublicense or commercially exploit the Service or its content without our written agreement; or
- misrepresent your affiliation with us, or use our trade marks without permission.
We may suspend or terminate accounts that breach these Terms (see Section 10).
8. Your content and your data
You retain ownership of the content and data you share in the Service, including chat messages. You grant us a licence to host, store, process and display that content solely to operate and improve the Service, and as otherwise described in our Privacy Policy.
Testimonials and stories.
We will never use your story, words, image or experience in our marketing, advertising or public materials without first obtaining your separate, written permission.
Feedback.
If you send us suggestions, ideas or feedback about the Service, you agree we may use them to improve the Service without restriction or obligation to you. Feedback does not include your health data or personal stories.
9. Our intellectual property
The Service and all of its content, including The Thompson Method educational materials, text, video, audio, graphics, software, logos and trade marks are owned by or licensed to us and protected by intellectual property laws.
We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use while you hold an active subscription. All other rights are reserved.
10. Service availability and changes
We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify features, run maintenance, or update content from time to time. If we make a change that materially reduces the core functionality you are paying for, you may cancel and, where required by law, receive a pro-rata refund of pre-paid fees for the unused period.
11. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (in which case we will give you reasonable notice and a pro-rata refund of pre-paid, unused fees). Sections 3, 8, 9, 12, 13 and 14 survive termination.
12. Disclaimers and limitation of liability
Nothing in this section limits your rights under the Australian Consumer Law or any other rights that cannot lawfully be excluded.
Subject to that:
- The Service is provided “as is” and “as available”. We do not warrant that content is complete, accurate or suitable for your individual circumstances.
- To the maximum extent permitted by law, we exclude all liability for indirect, incidental, special or consequential loss, loss of data, or loss of opportunity arising from your use of the Service, including any reliance on AI-generated responses.
- Where liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied; and our total aggregate liability to you is otherwise capped at the amount you paid us in the 12 months before the event giving rise to the claim.
- Nothing in these Terms excludes liability for fraud, or for death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
13. Indemnity
To the extent permitted by law, you agree to indemnify us against claims and losses arising from your breach of these Terms or your unlawful use of the Service, except to the extent we caused or contributed to the loss.
14. Governing law and disputes
These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland. If a dispute arises, please contact us first at care@thethompsonmethod.com as most issues can be resolved quickly and informally. Nothing in this section prevents you from making a complaint to a consumer protection regulator in your jurisdiction.
15. General
- Changes to these Terms. We may update these Terms from time to time. For material changes we will give you at least 14 days’ notice in the app or by email. Continued use after the effective date constitutes acceptance; if you do not agree, you may cancel before the change takes effect.
- Entire agreement. These Terms, the Privacy Policy and any plan-specific terms presented at checkout form the entire agreement between us regarding the Service.
- Severability. If any provision is found invalid, the remainder continues in effect.
- No waiver. A failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them as part of a business restructure or sale, with the protections in our Privacy Policy continuing to apply.
